ALBION – A Sturgis man is facing a charge of rape in Northern Indiana.
Officials with Noble County Circuit Court say that 28 year old Jose Vazquez-Diaz is charged with rape and is being held in the Noble County Jail on a $100,000 bond. If he is able to post bond, Vazquez-Diaz is not to have any
contact with the alleged victim.
Court personnel say the Kendallville Police were contacted April 7 by the alleged victim, who had accompanied Vazquez-Diaz to a birthday party on Grove Street in Kendallville on April 6. She told police that during the party, she started feeling sick and went to sleep in a bedroom at the house.
The victim told police around 1 AM she woke up with Vazquez-Diaz on top of her, with his hand over her mouth and he was raping her. She said that she attempted to push Vazquez-Diaz off of her and told him “No” several times. The victim says Vazquez-Diaz held her arms down and pushed her head down to keep her from getting away.
She also reported to investigators that Vazquez-Diaz told her that he was going to do this to her.
The woman was taken to Parkview Noble Hospital for treatment of neck, abdomen and back pain. She was also evaluated at the Fort Wayne Sexual Assault Treatment Center.
Vazquez-Diaz is scheduled to have his next court appearance on June 24 at 2 PM in Noble Circuit Court. If he is found guilty, he could face between 3 and 16 years in prison.
